1. Acceptance of Terms
These Beta Assessment Platform Terms and Conditions govern your access to and use of the Gradstack AI Fluency Index (GAFI) beta assessment platform and all related features, content, assessments, scoring, analytics, and outputs.
By ticking the acceptance checkbox, creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Platform.
If you are accepting these Terms on behalf of an organisation, you accept them both for yourself and on behalf of that organisation.
These Terms form a binding agreement between you and us from the moment you accept them.
2. Beta Program Nature
The Platform is provided as a beta release for evaluation, testing, and development purposes.
Beta features are pre-release, still under active development, and are not a final or commercially released product.
The Platform may contain errors, defects, incomplete functionality, or inaccuracies, and may behave unpredictably.
We may modify, suspend, limit, or discontinue any part of the beta program at any time, with or without notice, and without liability to you.
Participation does not create any entitlement to continued access, a commercial release, or any future version of the Platform.
3. Eligibility and Authority
You must be at least 18 years of age to use the Platform.
You warrant that all information you provide during registration and use is accurate, current, and complete.
If you accept these Terms on behalf of an organisation, you warrant that you have authority to bind that organisation.
You are responsible for maintaining the confidentiality of account credentials and activity under your account.
We may refuse, restrict, or revoke access to any person or organisation at our discretion.
4. Scope of Services
The Platform provides an AI fluency assessment that measures and reports an indicative level of AI capability, together with related analytics, benchmarking, reporting, and learning and development pathway recommendations.
Features, assessments, scoring methods, benchmarks, analytics, models, and outputs may change during the beta period.
The Platform may include links or references to third party learning resources and certifications. We do not provide, host, control, or guarantee those resources.
Nothing in these Terms obliges us to provide any particular feature, output, result, or level of service.
5. Experimental Nature of the Platform
The Platform is experimental and its assessment methodology, scoring logic, benchmarks, and outputs are under development.
Scoring criteria, level definitions, weightings, benchmarks, comparative data, and AI models may be added, removed, recalibrated, or replaced during the beta period.
Results generated at one point in time may differ materially from results generated at another point in time, including for the same inputs.
You participate in the Platform with full knowledge of its experimental nature and at your own risk.
6. No Warranty
To the maximum extent permitted by law, the Platform is provided on an as-is and as-available basis, without warranties, representations, or conditions of any kind.
We disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, and non-infringement.
We do not warrant that the Platform will be uninterrupted, secure, error-free, or free of harmful components, or that results or outputs will be accurate, complete, or reliable.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, where doing so would be unlawful.
7. Accuracy Disclaimer
Outputs from the Platform, including scores, levels, benchmarks, analytics, comparisons, and recommendations, are indicative only.
We do not warrant or guarantee that any output is accurate, complete, current, suitable, or fit for any particular purpose.
Outputs may be affected by incomplete data, evolving methodology, model limitations, user inputs, self-reported information, and the beta nature of the Platform.
You must independently verify any output before relying on it for any decision or purpose.
8. AI-Generated Results Disclaimer
The Platform uses artificial intelligence systems and automated processing to generate some or all assessments, scores, analyses, and outputs.
AI-generated outputs may contain errors, omissions, bias, or content that is misleading, incomplete, or factually incorrect.
AI-generated outputs do not constitute professional, legal, employment, psychological, educational, or other advice.
You are solely responsible for evaluating the suitability and reliability of any AI-generated output before acting on it.
9. No Employment or Hiring Reliance
The Platform is an assessment and development tool. It is not a hiring decision system.
Outputs must not be relied upon as the sole or primary basis for recruitment, hiring, employment, promotion, remuneration, capability, performance, disciplinary, or evaluation decisions.
Each organisation and user remains responsible for its own decisions and for compliance with applicable laws, including anti-discrimination, privacy, work health and safety, and employment laws.
We are not involved in, and accept no responsibility for, any decision made by you or any third party using the Platform or its outputs.
10. Limitation of Liability
To the maximum extent permitted by law, and subject to non-excludable rights, we and our directors, officers, employees, contractors, and agents are not liable for indirect, incidental, special, consequential, or punitive loss or damage.
We are not liable for loss of profits, revenue, business, opportunity, goodwill, anticipated savings, or data; reliance on any output; or recruitment, employment, or evaluation decisions made using the Platform.
Our total aggregate liability is limited to the greater of the amount paid to us for access to the Platform in the 12 months preceding the event giving rise to liability, or AUD $100.
Where the Platform is supplied at no charge, you acknowledge that these limitations are reasonable having regard to the experimental, no-cost nature of the beta program.
11. Indemnity
To the maximum extent permitted by law, you indemnify us and our directors, officers, employees, contractors, and agents against claims, liabilities, losses, damages, costs, and expenses arising from your access to or use of the Platform, breach of these Terms, reliance decisions, submitted content or data, or breach of law or third party rights.
This indemnity survives termination of these Terms.
12. Participant Responsibilities
You are responsible for the accuracy and lawfulness of information, content, and inputs you submit.
You are responsible for obtaining consents and authorisations necessary for any data you submit, including consents from individuals whose information you provide.
You must use the Platform in compliance with applicable laws and your own policies.
You must promptly notify us of any unauthorised use of your account or security breach.
13. Acceptable Use
You must not use the Platform for unlawful, fraudulent, or harmful purposes; submit unlawful, defamatory, infringing, offensive, or malicious content; attempt unauthorised access; disrupt the Platform; reverse engineer, decompile, scrape, copy, or attempt to derive source code, methodology, scoring logic, or models; build or train a competing product; or commercially exploit the Platform without written consent.
We may investigate and take action in response to suspected breach, including suspending or terminating access.
14. Confidentiality
Confidential Information means non-public information disclosed in connection with the Platform that is marked confidential or that a reasonable person would understand to be confidential, including non-public features, methodology, scoring logic, benchmarks, outputs, and participant information.
Each party must keep the other party's Confidential Information confidential, use it only for the purposes of these Terms, and protect it using reasonable measures.
We will not publicly disclose your confidential or personally identifiable participant information except as permitted by these Terms, required by law, or with your consent.
15. Privacy and Data Handling
We handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy.
We collect, use, and store personal information for operating, providing, evaluating, and improving the Platform, and for the purposes described in these Terms and our Privacy Policy.
Where you submit personal information about other individuals, you are responsible for ensuring that you have a lawful basis and all necessary consents.
If there is any inconsistency between these Terms and our Privacy Policy in relation to personal information, the Privacy Policy prevails to the extent of the inconsistency.
16. Consent to Data Collection and Use
By using the Platform, you consent to our collection, use, storage, processing, and disclosure of your data and inputs as described in these Terms and our Privacy Policy.
You consent to us using your data and inputs to operate the Platform, generate outputs, conduct analytics and benchmarking, evaluate and improve the Platform, and develop our products and services.
You consent to the processing of your data and inputs by third party service providers, including cloud and AI providers.
You may withdraw certain consents by contacting us, but doing so may prevent us from providing some or all of the Platform.
17. Use of Submitted Inputs and Responses
Inputs means prompts, answers, responses, files, usage data, feedback, analytics data, and other content you submit to or generate through the Platform.
You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, analyse, and use your Inputs for operating, providing, evaluating, securing, and improving the Platform and our products, services, analytics, scoring models, benchmarking, and AI systems.
We may use your Inputs internally to develop, train, test, refine, and improve the Platform, including its assessments, scoring models, benchmarks, analytics, and AI systems.
This clause does not transfer ownership of your original Inputs to us, except in relation to anonymised and aggregated data.
18. Anonymised and Aggregated Data Rights
We may create anonymised and aggregated data derived from your Inputs and use of the Platform.
Aggregated Data does not identify you or any individual and is not personal information.
We own all Aggregated Data and may use, retain, reproduce, disclose, commercialise, and exploit it indefinitely for any purpose, including analytics, benchmarking, reporting, research, training of models, and product development.
19. Third-Party Services and AI Providers
The Platform relies on third party services, including cloud hosting providers and third party AI providers, to operate and process Inputs and generate outputs.
By using the Platform, you acknowledge and consent to your Inputs being processed by these third party providers for the purposes of operating the Platform.
Third party services are subject to their own terms and policies. We are not responsible for their acts, omissions, availability, performance, or security.
20. Security Disclaimer
We take reasonable steps to secure the Platform and the data it holds, but no system is completely secure.
We do not warrant or guarantee that the Platform, your data, or your Inputs are immune from unauthorised access, loss, corruption, interception, or other security incidents.
Given the beta nature of the Platform, security controls may not be at the level of a commercially released product.
21. Suspension and Termination
We may suspend, restrict, or terminate your access to the Platform at any time, with or without notice, including where we reasonably believe you have breached these Terms or where required to protect the Platform, other users, or any third party.
You may stop using the Platform at any time. We may discontinue the beta program or Platform, in whole or in part, at any time.
On termination, your right to access the Platform ceases. Clauses that by their nature should survive termination continue to apply.
22. Changes to the Platform
We may change, update, add to, or remove any feature, function, assessment, scoring method, benchmark, analytic, model, or output of the Platform at any time during the beta period, with or without notice.
You acknowledge that such changes may affect outputs, including scores and benchmarks, and that we are not liable for any impact arising from those changes.
23. Changes to the Terms
We may amend these Terms at any time by publishing updated Terms on the Platform and updating the version date.
Material changes will be notified by reasonable means, which may include in-Platform notice or email.
Your continued use after updated Terms take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform.
24. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia.
You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts competent to hear appeals from them.
25. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision is to be read down to the minimum extent necessary, or severed, and the remaining provisions continue in full force and effect.
26. Entire Agreement
These Terms, together with our Privacy Policy and any document expressly incorporated by reference, constitute the entire agreement between you and us in relation to the Platform.
No variation of these Terms is effective unless made in accordance with these Terms or otherwise agreed in writing.
27. General
You must not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations.
A failure or delay by us to exercise a right is not a waiver of that right.
Nothing in these Terms creates a partnership, agency, joint venture, or employment relationship between the parties.
Notices to us must be sent to the contact email below. Notices to you may be sent to the email associated with your account.
