GRADSTACK WEBSITE TERMS AND CONDITIONS
Gradstack is an early-career capability, employability and opportunity-matching platform operated by Graduated Pty Ltd.
These are our terms and conditions (Terms, as at 26 March 2026) which apply to your access to and use of our website, including any content and functionality, offered at https://www.gradstack.com.au and any related platforms or services (Website).
These Terms form a legally binding agreement between Graduated Pty Ltd (ABN 51 671 531 758) trading as Gradstack (Graduated, Gradstack, we, us or our) and you, being the individual or organisation accessing or using the Website (you).
Each of us is a Party and together the Parties.
These Terms incorporate our Privacy Policy, which forms part of this agreement. By accessing or using the Website, you acknowledge and agree to be bound by these Terms and the Privacy Policy.
INTELLECTUAL PROPERTY
In consideration for you accepting and complying with these Terms, we grant you permission to access and use the Website.
Unless otherwise stated, we own all right, title and interest (including all Intellectual Property Rights) in the Website and all content made available through it.
You must not, without our prior written consent or except as expressly permitted by these Terms:

PLATFORM ROLE & NO EMPLOYMENT GUARANTEE
Gradstack is a capability, employability and opportunity-facilitation platform.
We do not:
- act as an employer, recruitment agency or employment intermediary;
- guarantee interviews, offers, employment outcomes or hiring decisions;
- verify the accuracy of employer or candidate representations beyond stated platform processes.
All hiring, engagement and opportunity decisions are made solely by users of the platform.
ACCURACY OF INFORMATION
Information on the Website is general in nature and may not be comprehensive or current.
To the maximum extent permitted by law, including the Australian Consumer Law, we do not warrant the accuracy, completeness or suitability of information on the Website.
You are responsible for verifying information before relying on it.
DISCLAIMER
To the maximum extent permitted by law, the Website is provided “as is” and “as available”.
We do not guarantee uninterrupted access, error-free operation, or that outcomes achieved through the Website will meet expectations.
Nothing in these Terms excludes, restricts or modifies rights you may have under the Australian Consumer Law that cannot be excluded.
LIABILITY
To the extent permitted by law, we are not liable for any indirect, consequential or economic loss arising from your use of the Website.
Where liability cannot be excluded, our liability is limited (at our option) to resupplying the services or paying the cost of having the services supplied again.
INDEMNITY
You agree to indemnify Graduated Pty Ltd, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:
- all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your access or use of our Website;
- any direct or indirect consequences of you accessing, using or transacting on our Website or attempts to do so; and/or
- any breach of the Terms.
DISPUTE RESOLUTION
If a dispute arises, a Party must give written notice describing the dispute and the desired resolution.
The Parties must attempt to resolve the dispute in good faith through negotiation within 28 business days.
If unresolved, the dispute must be referred to mediation administered by The Resolution Institute, with each Party bearing its own costs.
Nothing prevents either Party from seeking urgent injunctive relief.
PRIVACY
Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
TERMINATION
We may suspend or terminate your access to the Website at any time if you breach these Terms or pose risk to the platform or other users.
Upon termination, your right to use the Website immediately ceases.
GENERAL
Assignment: You must not assign your rights without our prior written consent.
Force Majeure: We are not liable for delays or failures beyond our reasonable control.
Relationship of Parties: Nothing in these Terms creates a partnership, employment, agency or joint venture.
Severance: If any provision is invalid, the remainder remains enforceable.
GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.
Each Party submits to the exclusive jurisdiction of the courts of New South Wales.
